An application for Anticipatory Bail is filed before the Hon’ble Sessions Judge or the High Court under the provisions of the Bharatiya Nagarik Suraksha Sanhita (BNSS) / Section 438 CrPC. It requires establishing that the apprehension of arrest is genuine, that the accusation stems from malafide or civil reasons, and that the applicant will fully cooperate with the investigating officer.

Under Supreme Court Rules, only an Advocate-on-Record (AOR) is legally authorized to file petitions, vakalatnama, and pleadings on behalf of a litigant before the Hon’ble Supreme Court of India. Senior Advocates and other advocates argue upon being briefed by the designated AOR.

Aggrieved homebuyers can file complaints under Section 18 of the Real Estate (Regulation and Development) Act (RERA) before the State RERA Authority to demand a 100% refund with interest (typically SBI MCLR + 2%). Alternatively, if the buyer does not want a refund, they can claim monthly interest penalties for every month of delayed delivery until possession with an occupancy certificate is handed over.

Under Bar Council of India (BCI) rules, legal fees are mutually agreed between the client and advocate on a professional fee schedule basis (per appearance, drafting, or retainership). Contingency fee agreements (% of claim recovered) are prohibited under Indian ethics rules. We offer clear, transparent fee agreements with detailed receipts for all legal filings.
